            I hope all is well. I’ve got a little ear infection, but the drops they gave me seem to be working. Other than that, just busy being busy.
           
            I’m writing you today because I’m not sure if I told you that I was denied, again, on getting out of High Security. For those that don’t know, I was sent here almost three years ago because they found some recording equipment in my cell.  That wa at the Powledge Unit in Palestine, Tx. Now, I live at the Allred Unit in Iowa Park, Tx.

            When I first got here, I kept getting in trouble, so it was understandable that they wouldn’t let me out. Ya see, in High Security there is no TV, no payphones, no contact visit, and even when you go to the dentist, you have to be handcuffed. It’s tough time and times are tough, but it’s not that big of a deal. But I’ve been staying out of trouble lately, and so I thought I had a good chance of going to regular prison, which they call “general population.” But I was denied, and I’ll have to wait till October to see the committee again. That means another 4 ½ months in the house of doom.

            I’ve been so busy working on a video treatment for “Angels” that I’m not even sure if they’ve got the next song ready for you. It was supposed to be “People”. I hope they got it for you, but if not, don’t worry, I’ll take care of it. I promised you a song every 45 days till the album drops, and that’s what you’ll get.

            This is a very short Quick Update, but I’ll scribble you a Quick Sixteen, just so you won’t cuss me out, or nothing.

You know what? Let me do something else, here. I remember reading, on one of Incandesio’s letters, a verse that a guy named Jae Stylez wrote. Weekend Reading 72 (A Farewell to Eric)

It is with great sadness that I announce the end of Eric’s run as Blog Whipping Boy.

Eric has decided that his inability to mount an effective counterargument makes it necessary to lurk around on myFacebook page and...well, I’m not sure what he’s trying to use the information for. He’s concocted yet another imaginary scenario in which I could call Sylvia Coy and get the transcripts but, for some as-yet undisclosed nefarious reason, refuse to.

Eric, if you really need me to explain to you why I will not call a complete stranger and demand expensive legal documents from her, then you’ll never understand it.

Now, this business of you looking me up on a public social network; honestly, I don't give a shit. You can “lol post stuff” from sun-up to sun-down, and it will only serve to increase my amusement at your general rage-iness. Still, a lot of the people I’ve friended have pictures of their kids, their homes, and their businesses there, and the thought of an aggressively foolish stranger wanking off to any of the above is, as I mentioned before, extremely creepy.

I have come to the conclusion that, since you’ve moved your arguments from the case to the transcripts, from the transcripts to my motivations, and now from my motivations to my character, any interest you may add to the discussion is outweighed by the possibility that you're going to go ape-shit and hurt someone (namely me.)  I have rebuffed your repeated attempts to meet with me in person, and still have no desire to do so. If I continue responding to you online it’s possible that your frustration will become too great for you to deal with, so we’re done; while I pride myself on my ability to respond to all comers, I don't want to be responsible for a potential case of blog-rage. I’m not going to turn on comment moderation, but I will delete yours when I find them. 


To the people that will come here in the future after being told by Eric that I banned him because I couldn't answer his arguments, I invite you to take a look at any of our exchanges and judge for yourself.

Letter to Mike Anderson 9

Another letter to the DA’s office! As you can see, I’m changing up the header a bit, trying to incorporate his title; it probably won’t make a difference, but I think it’s more correct. I’m writing today about the case of Carlos Coy, #908426.

I read an interesting story in the Waco Tribune, about how the Michael Morton exoneration has affected jury selection in cases from misdemeanors all the way up to capital murder; in a recent Williamson County trial, 10 of the 55 chosen as potential jurors have been disqualified or excused so far because of serious misgivings about the justice system related to the Morton case.

While it would be easy to dismiss this as local notoriety or simply a cynical way to avoid jury duty, I urge you to consider the implications of the recent wave of exonerations on the public’s perception of the justice system.

Jonathon Salvador’s influence has resulted in many drug cases being overturned already, with many more to come; although his situation has not been covered much by the news media, it is a topic of much conversation on blogs and forums associated with the justice system.

Sir, the citizens of Texas know that there are problems with the justice system; many of us suspect that there were problems with how Mr. Coy’s case was prosecuted. An investigation by your office would be very much appreciated, and not just by those of us who already believe that he was wrongfully convicted. The public should have faith that the government, while not perfect, is truly interested in ensuring justice for each and every one of us, even after the fact.

A proactive review of the trial and the police investigation leading up to it would inspire confidence in your office, and generate a lot of goodwill. Please, consider looking into this case; give us justice.

You may remember this post, where I mentioned the HPD shooting a one-armed, one-legged, wheelchair-bound man; The officer, who was defending himself from the ball-point pen being wielded by Brian Claunch, was recently no-billed by a Grand Jury.

""400 shootings of civilians in a row, all no billed" Said Attorney Randall Kallinen.

"How do you have so many shootings of civilians and that many no bills? You would think that the Grand Jury was making judgements on Jesus Christ. No police officers made any mistakes in these shootings?" asked Shelby Stewart."

Mandatory Ethics


You may recall a while back we talked about Mike Anderson’s training for his prosecutors; he ripped into the Innocence Project and seemed to suggest that it was the DA’s office against the world.

Well, Bexar County District Attorney Susan Reed wants to see prosecutors all over Texas required to make Brady education part of their mandatory training each year. The bill passed the House & Senate, and is currently awaiting Governor Perry’s signature. If you’re not familiar with Brady, that’s the requirement that prosecutors turn over any exculpatory evidence (that which tends to prove the defendant’s innocence.)

This was one of a number of bills and reforms inspired by the Michael Morton case; Morton was convicted and served 30 years for the brutal murder of his wife before it was revealed that his prosecutor had hidden evidence that could have exonerated him.

I think any effort to improve the administration of justice is a good thing, but it does leave me wondering how this could affect Coy’s case. There may be hidden information, but we have no way to know; remember, the police don’t appear to have made any effort to gather physical evidence in his case.

The first interview, that crucial ‘outcry’, was recorded with no audio. The mother’s first written statement, which could have shown consistency or inconsistency in the girl’s accusation, was discarded. The first police report, the first complaint, is hidden from the public by the Family Code.

Meanwhile, the Texas Court of Criminal Appeals is overturning Jonathon Salvador’s cases by the hundreds; Salvador is the Houston Crime Lab tech that was faking test results.

We know that one of Coy’s prosecutors got in trouble for a Brady violation some years after his case. Doesn’t that warrant at least a close second look at all her cases? If TDCJ wants to make sure their prosecutors know it’s wrong to lie and cheat to get a conviction, what better place to start than past cases?

I’m writing to you today about the case of Carlos Coy, #908426.

As you probably already know, the Texas legislature recently passed SB 344, which dictates guidelines to allow a prisoner to file a habeas appeal based on science that is now known to be faulty; hundreds of arson cases are currently being reviewed by the Innocence Project.

Mr. Coy was convicted on testimonial evidence, not physical. Empirically, there was no evidence that a crime had occurred; there was no physical evidence, or even an attempt to collect any. The ‘symptoms’ named by the state had been with the child for months, perhaps years before the date of the supposed assault.

The scientists that testified for the state accused Coy of grooming his daughter to be his next victim, but when confronted about it, they admitted that they had no evidence of it. It was an opinion, no more.

While I sincerely hope that everyone wrongfully convicted using bad science is freed, I also wonder how those who were convicted without even a pretense of scientific evidence can have their cases reconsidered. How can we refute an opinion, offered with no proof and accepted as fact?

Sir, I urge you to review this conviction; I firmly believe that it will eventually be called into question, and I hope to see that happen sooner rather than later. Carlos Coy, like every citizen, deserves a fair trial; given the state of the District Attorney’s office under Chuck Rosenthal, any case not based on firm evidence should be questioned.
